Motorcycle Operator/Passenger Waiver and Release of Liability Form

Overview: Because motorcycle operating (driving) and riding (as a passenger) can be inherently a dangerous activity that could result in injury or even death, participants (operators, riders and passengers) shall hold harmless; “The Sons of Helaman Motorcycle Club” (hereafter called “Sponsor”) and any person or persons, entity, managers, members, Directors or anyone else affiliated with the (Name of ride): “ ” (Hereafter called “ The Event”), or “Sponsor” for any damages, accidents, losses, injuries or death sustained or received while participating in “The Event.” It is expected that every operator is well orientated to his/her motorcycle and how to operate it safely. The operator agrees to obey all local and state traffic and motorcycle operation laws during participation in the event.

Operator Requirements: All operators must be 18 years or older and are responsible to possess a valid operator permit that qualifies him/her to operate a motorcycle in the country or state of origin. Additionally, every motorcycle owner must maintain motor vehicle insurance that meets or exceeds the minimum standard for the State in which the motorcycle is registered. This includes liability insurance coverage. The operator is solely responsible to provide safety to and for their passenger as well as safe operating practices with any/all other motorcycle operators and participants participating in The Event.

Helmets: In connection with safe riding guidelines, it is highly recommended that every operator will provide his/her own helmets and other protective clothing for The Event. However, Utah State law does not require anyone over the age of 18 years old to wear a helmet. It is left to the discretion of each motorcycle operator and/or passenger on whether or not to wear a helmet. Each operator and passenger shall be individually responsible to wear an approved helmet if The Event takes the riders and/or passengers through a state that requires the use of a helmet.

Fuel: Costs of fuel are the sole responsibility of each operator. “Sponsor” shall not be responsible for any motorcycle fuel consumption and mileage to any operator for ride participation.

Breakdown and Accident Towing: Each operator is solely responsible for any and all repairs, breakdowns, damages to motorcycle, other private property and towing expenses that may occur to the operator’s motorcycle during The Event.

Alcoholic Beverage or Controlled Substance Consumption: Alcoholic drinks shall not be sold during The Event by any participant of The Event. Consumption of alcohol or use of any controlled substance at any time during The Event is expressly prohibited and shall result in cancellation of any/all riding privileges and may result in a report being filed with local authorities.

Reservations: Reservations must be paid in full to be guaranteed by the riders. The “Sponsor” is not responsible for making reservations and each rider or passenger shall be responsible for their own accommodations. “Sponsor” assumes no responsibility for lost or stolen items during The Event.

Authorization: Participant hereby authorizes “Sponsor” to utilize his/her name and/or photographic image or representation in the promotion of its programs. No images or representations will be utilized for any financial gain.

Waiver: The undersigned hereby releases, waives, discharges and covenants not to sue the promoter, The Club, participants, managers, directors, members, Sponsor, volunteers, association, sanctioning organization or any subdivision thereof, grounds operator, sponsors, grounds owner, officials or any persons in any restricted areas, promoters, advertisers, owners and lessees of premises used to conduct The Event and each of their officers and employees, all for the purposes herein referred to as "releasees”, from all liability to the undersigned, including but not limited to damages or injury, whether caused by the negligence of the releasees or otherwise while the undersigned is in or upon the restricted area, event location, public roads, streets, rights of way, highways or other public or private areas, and/or competing in, officiating in, observing, working for, or for any purpose participating in The Event.

Indemnification: The undersigned hereby agrees to indemnify and save and hold harmless the releasees and each of them from any loss, liability, damage, or cost they may incur due to the presence of the undersigned in or upon the restricted area or in any way competing, officiating, observing, or working for, or for any purpose participating in The Event and whether caused by the negligence of the releasees or otherwise.

Risk of Damage or Bodily Injury: The undersigned hereby assumes full responsibility for the risk of bodily injury or property damage due to the negligence of releasees or otherwise while on or upon the restricted area and/or while competing, officiating, observing, or working for or for any purpose of participating in The Event. The undersigned certifies that he or she has no known mental or physical impairment that would affect him or her to safely operate a motorcycle or participate in The Event.

Acknowledgement: The undersigned expressly acknowledges and agrees that the activities of the event are dangerous and involve the risk of serious injury, death and/or property damage.

Force & Effect: The undersigned expressly agrees that the foregoing release, waiver and indemnity agreement is intended to be as broad and inclusive as is permitted by the laws of Utah and that if any portion thereof is held invalid it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

Representations: The undersigned has read and voluntarily signs the release and waiver of liability and indemnity agreement, and further agrees that no oral representations, statements or inducements apart from the foregoing written agreement have been made. I have read and agreed to the Terms and Conditions on pages 1 and 2:
